1. Acceptance of Terms

By accessing or using the SnapMenu website located at http://www.snap-menu.com/ and the services provided by SnapMenu ("SnapMenu," "we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent you have the authority to bind such entity. If you do not agree, you may not use the Service.

2. Description of Service

SnapMenu is a Software-as-a-Service (SaaS) platform that allows businesses, primarily in the food service industry (e.g., cafés, bakeries, food trucks), to digitize physical menus by uploading photographs. The Service uses AI to extract menu items and prices, enabling users to create, manage, and publish digital menus via a scannable QR code. Features include real-time updates, a basic analytics dashboard, and integration with platforms like Google and Tripadvisor for reviews.

3. Account Registration and Security

You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. License Grant & Restrictions

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

You agree not to:

  • License, sublicense, sell, resell, rent, lease, or otherwise commercially exploit the Service
  • Modify or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Access the Service to build a competitive product
  • Use the Service to store or transmit infringing or unlawful material

5. Fees, Payment, and Subscription Terms

  • Pricing Tiers: Fees are as specified on our pricing page. This includes the "Founder's Pricing" of a one-time setup fee for pre-orders, followed by a recurring monthly subscription fee.
  • Payment Processing: All payments are processed securely through Stripe, Inc. By providing payment information, you authorize us to charge the applicable fees through Stripe's payment processing service.
  • Subscription Term: Your subscription will automatically renew for successive periods unless you cancel before the renewal date.
  • 60-Day Money-Back Guarantee: If you are not satisfied with our Service within the first 60 days of your subscription, you may request a full refund of your initial payment. Refund requests must be submitted to snapmenu.info@gmail.com within 30 days of your initial purchase. This guarantee applies only to the first payment and does not apply to subscription renewals.
  • Price Changes: We may change our fees with at least 30 days' notice, effective at the start of your next billing cycle.

6. User Content & Ownership

Your Content

You retain all rights to the menus, photographs, text, and other data you submit ("User Content"). You grant us a worldwide license to use, host, and process your User Content solely to provide and improve the Service.

Our Property

We own all rights, title, and interest in the SnapMenu Service, software, and all related intellectual property. Your use does not transfer any ownership rights to you.

7. Term and Termination

  • This Agreement remains in effect while you use the Service.
  • You may cancel your subscription at any time via your account settings.
  • We may suspend or terminate your access immediately for material breaches of these Terms, including non-payment.
  • Upon termination, your right to access the Service ceases immediately. We will provide you with a reasonable opportunity to retrieve your User Content, after which we may delete it.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

9. Indemnification

You agree to indemnify and hold SnapMenu harmless from any claims, damages, or losses arising from your use of the Service, your User Content, or your violation of these Terms.

10. Governing Law and Disputes

These Terms shall be governed by the laws of Portugal. Any disputes shall be resolved in the courts located in Lisbon.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such notice constitutes acceptance of the new Terms.
